In Durango, a dog has won the first judicial protection; it is Laika, who was rescued more than three years ago from her former owner for animal abuse and exploitation. The administrative judge has already disagreed with the court’s decision.

Laika is a Belgian Shepherd Malinois dog, rescued on January 8, 2021 from a clandestine breeding farm located in the Viva Reforma neighborhood of this city, where her then owner mistreated her and crossed her for profit. The sale of this type of puppies on the market exceeds five thousand pesos.

Laika was rescued by the Committee for the Protection and Prevention of Animal Abuse after a complaint of abuse. The brigade was headed by Mayela de la Torre, who was accompanied by municipal public security elements.

They found Laika on the street, mistreated and full of ticks and fleas. Even so, they informed her then owner that the dog would be confined, and he accepted it; The dog was taken in by the association Conciencia Provida Animal y Medio Ambiente de Durango A.C., chaired by Amelia Salas.

A week later, the municipal administrative judge, Mario Pozo, asked Amelia Salas to return the dog to its owner. “I told him no, that we could not return the animal to mistreatment, but the judge insisted and they sent me a person with threatening behavior to return it,” said Amelia Salas.

From then on, Mario Pozo began constant harassment of the association to return Laika. The judge even asked for help from a Public Prosecutor’s Office, which also acted, according to Amelia Salas, illegally.

The judge issued a summons and a fine of nine thousand pesos for refusing to return the dog, which led the association to go to the Administrative Court of Justice to file an appeal against the decision of the administrative judge and the fine of the MP.

More than three years passed, and finally the Administrative Court of Justice issued a ruling in favor of Laika, establishing that she should not be returned to her former owner and annulling the fine imposed by the Public Prosecutor’s Office.

“This was a historic resolution,” revealed Amelia Salas and set a precedent in the defense of sentient beings.

However, according to Amelia Salas, Mario Pozo has already filed an appeal against the court’s ruling. “We are going to fight it. It is incredible that, given all the evidence presented, the judge wants to return the dog to the person who mistreated her,” she said.

Amelia Salas added that they have already filed a complaint with the State Anti-Corruption Prosecutor’s Office against Mario Pozo’s conduct, pointing out that someone who acts illegally cannot remain in that position.
